摘要	个人利益与公众利益是知识产权制度调整的利益关系中的主要矛盾，适当平衡个人利益与公众利益是知识产权制度设计和完善的关键所在。无论是实现知识产权权利人的利益，还是满足公众对知识产品合理需求的利益，都是促进人的发展和社会经济发展的必然要求。以人为本理念作为马克思主义唯物史观的深化理论，强调的就是在满足人们日益增长的物质文化需要基础上，保障人的发展，并促进社会经济的和谐发展。因此，本文在作知识产权个人利益与公众利益的平衡研究时，紧紧围绕科学发展观的以人为本核心思想。从以人为本的角度出发，对知识产权制度的功能进行考察和对个人利益与公众利益的冲突表现进行归纳分析。并把以人为本理念作为分析知识产权制度设计和完善的指导思想和衡量标准，贯穿评价和完善知识产权制度在平衡个人利益与公众利益具体措施的始终。
其他摘要	The main contradiction of the interest in the intellectual property is personal interests and the public interest. The key of the intellectual property system design and perfect is appropriately balance personal interests and the public interest. Both realize the interests of rights of intellectual property, and meet the reasonable requirements of the interests of products of public knowledge, which are the necessary requirement of promote development of humans and socio-economic. The idea of people-oriented as the deepening of theoretical Marxist historical materialism, which emphasizing that safeguard people's development and to achieve the harmonious development of human and socio-economic must basic on the meet of the people's growing material and cultural needs, it also promote the harmonious development of social economy.
