摘要: To solve the problem that the mechanical behavior of undisturbed loess in seasonally frozen soil area is affected by freeze-thaw action, triaxial shear tests of undisturbed loess under freeze-thaw condition were carried out. The results show that the mechanical properties of undisturbed loess are greatly affected by factors including freeze-thaw process, water content, natural density and confining pressure. Freeze-thaw action has a certain impact on the failure surface shape and stress-strain curve. Before and after freeze-thaw, the shape of the shear failure surface is complex, including single oblique failure surface, double oblique failure surface, vertical failure surface, X-shaped failure surface, bulging failure, etc. And under the conditions of low water content, low confining pressure and high dry density, the stress-strain curve tends to be softened. Conversely, the curve tends to harden. Freeze-thaw action can make the stress-strain curve transition from softening to hardening. In addition, the freeze-thaw action significantly weakens the failure strength, shear strength, cohesion, initial tangent modulus and failure ratio of undisturbed soil, but does not change the internal friction angle obviously. Also, the heterogeneity of natural soil is also an important factor affecting the mechanical parameters, failure surface shape and stress-strain curve of undisturbed loess.

摘要: 马克思主义哲学强调目的具有能动性,正是因为目的具有能动性,使得主体活动具有方向性,是故环境法典编纂目的反映了预期中环境法典的成果。总览世界范围内的法典编纂历史,对法典编纂目的论的研究始终居于基础性地位受到广泛重视。丰富环境法编纂目的论的内涵是完善我国环境法典学理基础的必然选择。将去技术化纳入环境法典编纂的目的,直面了环境法对开放性的诉求与法典的稳定性之间的矛盾,对解决环境法典编纂一元目的论的痛点有所裨益,有助更好地证成环境法典编纂的必要性,对探寻环境法典制定的最优方案有所助力。

摘要: 能源产业低碳发展是黄河流域高质量发展的重要内容,也是实现全国双碳目标的重要路径。当前,黄河流域能源产业低碳发展面临能源基本法缺位、单行法体系不完整、现行能源法律与《黄河保护法》衔接不足、低碳技术创新及能源产业市场驱动缺乏法律保障等问题。提出加快《能源法》立法进程、促进能源立法与《黄河保护法》目标协同、完善能源产业低碳技术保障机制、法律确认流域可再生能源优先发展地位等建议。同时,建立黄河流域能源产业低碳转型协商及多能互补式省际协作法律保障机制、发挥能源政策的多维度协调作用、协同推进流域能源产业低碳发展与生态环境保护等多元法律协调机制。承担流域“双碳”目标责任,实现黄河流域能源产业低碳发展目标。

题名: The contemporary value, basic framework and realization mechanism of the rule of law in rural revitalization

摘要: With the goal of exploring the efficiency of the rule of law in rural revitalization, this paper analyzes the governance outcomes of the rule of law in rural revitalization from three aspects: the value of the times, the basic framework, and the mechanism of realization. The process of rural rule of law institutional change can be constructed by analyzing the mechanism characteristics of institutional change. The super-efficient SBM model is constructed based on the DEA method, and the modernization of rural governance capacity is solved by combining the governance theory, so as to achieve the effect of measuring the efficiency of rural revitalization of the rule of law. Improve the accuracy of efficiency measurement by adding the Malmquist index. The efficiency test model for rural revitalization rule of law is constructed to test the effects of rural rule of law. The results show that the epochal value of the rule of law in rural revitalization is mainly reflected in the scientific, digital and normative aspects, and the digital value embodied in the highest proportion of 0.8137, followed by normative, the value embodied in the degree of 0.7908. The content of ecological revitalization rapidly increases from 4 to 70 after the 5th cycle, and the degree of influence peaks in the 12th cycle. The research in this paper provides a new governance direction for the rule of law in rural revitalization, which can further improve the rule of law system in rural areas. © 2023 Xinli Yuan et al., published by Sciendo 2023.

摘要: A novel dimeric phenolato Hafnium complex [{HfIV(Salan2,4-Me)(OnBu)}2O] was synthesized by reacting [HfIV(Salan2,4-Me)2] in the presence of 100 equiv. of H2O. The structure was characterized by 1H, 13C No spectroscopy, HRMS and X-Ray diffraction. In comparison with [HfIV(Salan2,4-Me)2] and another precursor [{HfIV(Salan2,4-Me)(OnBu)}2O], this dimeric HfIV complex demonstrated enhanced aqueous stability and antitumor activity (IC50: 71.2 +/- 25.3 mu M against Hela S3 cells; 62.2 +/- 27.7 mu M against Hep G2 cells). Further-more, this dimeric HfIV complex can only be synthesized from [HfIV(Salan2,4-Me)2] in low equivalent of H2O, upon addition of 2,6-dipicolinic acid, it can be transformed to a Salan/Dipic HfIV bis-chelated complex.

摘要: 近年来,随着网络传播技术的迅猛发展,同人作品逐渐跳出同人圈而走向了大众视野,与此同时,其所存在的著作权侵权风险也暴露无遗,然而我国著作权法却并未对同人作品进行明确规定,这就需要通过理论和实践研究作进一步的阐释。就现有研究而言,同人作品著作权侵权相关研究数量快速增长,内容愈加细致深入,概念和特征研究基本成熟,整体发展态势良好。但是也应当看到,现有研究在同人作品的认定、法律定位、保护和实证研究等方面还略有不足。因此,本文试图将同人作品侵权的相关问题进行梳理,以期为今后的相关理论和实践研究奠定基础。

摘要: 传统契约是古代社会保障民间交易安全的重要手段,唐末、五代、宋初时期敦煌的借贷契约与买卖契约所呈现的担保责任制度体现了当时“官依政法,民从私契”的民间契约自治与国家合理规制之间的利益平衡关系。敦煌契约文书担保责任形式具有多样性,敦煌借贷契约的担保形式有四种:一是债务人质典动产或不动产。二是债权人在债务人负债不还的情况下牵掣其家资杂物牛畜。三是保人代偿,即唐《杂令》中所规定的“如负债者逃,保人代偿”。四是役身折酬,即以劳务抵债担保,在债务人“家资已尽,无力偿债”的情况下,债权人拘禁债务人本人及其户内男口,以债务人或其家内男子的劳务代偿债务。敦煌契约文书担保责任制度由当时政治、经济、文化发展状况所决定,体现了自然经济、家族主义及熟人社会的历史特色。敦煌契约文书担保责任制度所蕴含的“私契自治”“诚实守信”“平等协商”“私力救济与公力救济相互补充”等传统法文化资源具有重要的启示意义与现代价值。深入研究敦煌契约担保责任等传统契约法文化资源的创造性转化与创新性发展问题,有助于促进新时代中国特色社会主义法治文化建设。

摘要: 人类生殖系基因编辑技术飞速发展,为我国罕见病患者基因治疗带来了机遇。由于其自身安全、技术伦理、技术滥用、生物安全等风险,立法明令禁止该技术的医疗应用,致使罕见病患者无法借助这一技术治愈自身疾病。为促进技术合理发展、保障少数群体基本权利、实现正义价值,生殖系基因编辑技术应从禁止应用转向合理应用。技术的合理应用应遵循例外允许、必要性、风险评估、后世代利益持续保护原则。为了更好落实这些原则,应匹配技术合理应用的分类规制规则、严格准入规则、审慎监管规则。人类生殖系基因编辑技术合理应用的制度调适,既能防范技术应用的潜在风险,又能促进技术在人类生命与健康发展中尽其所长,进而提升人类的共同福祉。
